These Terms of Use (“Terms”) govern your use of the GPS Toolkit mobile application (“the App”), published by Twixtech. By installing or using the App, you agree to these Terms. If you do not agree, do not install or use the App.

1. License

Twixtech grants you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control.

You may not:

• copy, modify, decompile, or reverse-engineer the App;
• redistribute, sell, sublicense, or rent the App or any part of it;
• remove or alter any proprietary notices.

2. Price and in-app purchases

The App is provided free of charge in version 1.0, with no in-app purchases, no subscriptions, and no advertising.

Future versions may introduce optional paid features (for example a premium tier unlocking advanced functionality). If and when that happens, these Terms will be updated before those features ship, and any purchase will be processed by Apple StoreKit or Google Play Billing, subject to Apple’s or Google’s policies.

3. GPS readings — important safety notice

The App displays GPS-derived measurements (position, speed, distance, altitude, heading, bearing to waypoints) and sensor-derived readings (barometric altitude, magnetic compass heading). These measurements depend on:

• your device’s GNSS hardware and the availability of compatible constellations (GPS, GLONASS, Galileo, BeiDou, QZSS);
• sky visibility, atmospheric conditions, and multipath interference;
• satellite geometry and signal quality;
• for the barometer: ambient pressure changes (weather) which affect uncalibrated altitude readings;
• for the magnetic compass: local magnetic interference (metal structures, electronics, vehicles) which can deflect the reading.

Readings can be inaccurate, delayed, or unavailable. You must not rely on the App for:

• aviation, maritime, or any other safety-critical navigation;
• search-and-rescue operations or emergency situations;
• medical, legal, or insurance purposes;
• professional surveying or any application requiring certified accuracy;
• any situation where measurement errors could cause physical, financial, or legal harm.

The App is intended as an informational and recreational tool only. It is not a certified navigation device. For safety-critical use, rely on certified equipment and qualified personnel.

4. Warranty disclaimer

The App is provided “as is” and “as available,” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Twixtech does not warrant that the App will be uninterrupted, error-free, or compatible with all devices or future operating system versions. Map tile availability (when using the OpenStreetMap engine) depends on third-party servers and is not guaranteed.

5. Limitation of liability

To the maximum extent permitted by law, Twixtech shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including loss of data, loss of profits, physical injury, property damage, or damages caused by inaccurate GPS or sensor readings.

Because the App is provided free of charge in v1.0, Twixtech’s total aggregate liability under these Terms is limited to a symbolic amount of one euro (€1). In any case, Twixtech’s total liability for paid features, should they be introduced in future versions, is limited to the amount you actually paid in the twelve (12) months preceding the claim.

Nothing in these Terms excludes liability that cannot be excluded under applicable law (notably mandatory consumer-protection laws and liability for gross negligence or wilful misconduct).

6. User data and content

You retain full ownership of the waypoints, tracks, notes, and other content you create in the App. All such content remains on your device — Twixtech has no access to it. You are solely responsible for backing up your content (the App provides a built-in backup/export feature for this purpose).

You are solely responsible for any content you choose to export and share with third parties. GPX and KML exports contain your coordinates in plain text by design.

7. Intellectual property

The App, including its source code, assets, design, and trademarks (“GPS Toolkit,” “Twixtech”), is the exclusive property of Twixtech and is protected by copyright and trademark law.

Map data displayed in the App is provided by third parties (Apple Maps, OpenStreetMap contributors) and is subject to their respective licenses. OpenStreetMap data is licensed under the Open Database License (ODbL); attribution is displayed within the App.

These Terms grant you a license to use the App, not ownership of any of its components.

8. Updates and modifications

Twixtech may release updates at any time, including bug fixes, feature additions, or removals. We may modify these Terms; the updated version will be published at the same URL with a new effective date. Continued use after changes constitutes acceptance.

9. Termination

You may stop using the App at any time by uninstalling it. Twixtech may terminate your license if you breach these Terms. On termination, the license granted in section 1 ends immediately. Uninstalling the App removes all locally stored data.

10. Governing law and jurisdiction

These Terms are governed by French law. Any dispute will be subject to the exclusive jurisdiction of the courts of Nanterre, France, except where mandatory consumer-protection law grants the consumer the right to bring proceedings in their place of residence.
